Supreme Court Allows Idaho Law Banning “Sex Change” Treatments for Minors
Some justices warned against lower court judges seeking to “govern an entire State from the courtroom”
The United States Supreme Court has ruled that an Idaho law banning the use of cross-sex hormones, puberty blockers, and plastic surgery for minor “sex changes” may be enforced amid ongoing litigation against the legislation.
Idaho’s Vulnerable Child Protection Act was temporarily blocked by Clinton-appointed U.S. District Judge B. Lynn Winmill in December following a lawsuit brought by the ACLU against the state on behalf of just two teenage plaintiffs.
Supreme Court justices, however, voted 6-3 in favor of turning over Winmill’s ruling last week, as The Christian Post reported.
"In recent years, certain district courts across the country have not contented themselves with issuing equitable orders that redress the injuries of the plaintiffs before them, but have sought instead to govern an entire State or even the whole Nation from their courtrooms," wrote Justice Neil Gorsuch, who was joined in his opinion by fellow reliably conservative Justices Clarence Thomas and Samuel Alito.
Meanwhile, the ACLU responded by decrying the decision as “awful” for the families of transgender teenagers in Idaho.
"Today's ruling allows the state to shut down the care that thousands of families rely on while sowing further confusion and disruption," attorneys for the legal organization said in a statement. "Nonetheless, today's result only leaves us all the more determined to defeat this law in the courts entirely, making Idaho a safer state to raise every family."
There is a term used to describe the way the left leverages lawsuits and the court system to enact its agenda: lawfare.
It’s apt in this case. The people of Idaho have elected representatives to pass legislation that is in line with their values, and they have done so in this case. Meanwhile, a left-wing activist group is trying to challenge the people’s self-governance.
